This Privacy Policy concerns the processing of your personal data by the company "Athanasios Papathanasiou" and its website www.brandsamsara.com, which is the online store for the exhibition/disposition and purchase on consignment of products via the Internet, including women's authentic branded clothing, bags, shoes and accessories, both new and used, located in Greece, L. This information is addressed to natural persons who carry out any transaction with the online store, such as, but not limited to, customers who create a personal account to use the Services of the Company and/or subscribe to the sending of newsletters (Newsletter).

The Company, in compliance with the applicable legal framework, has taken all the necessary actions, applying the appropriate technical and organizational measures for the legal maintenance, processing and safe keeping of the personal data file, committing to ensure and protect in every way the processing of your personal data from loss or leakage, alteration, transmission or any other unlawful processing.

The term "Personal Data" refers to information of natural persons, such as name, postal address, e-mail address, contact telephone number, etc., which identifies or can identify you, hereinafter referred to as "Personal Data" or "Data".

Any operation or set of operations which is performed, with or without the use of automated means, on Personal Data or sets of Personal Data, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or any other form of making available, alignment or combination, restriction, erasure or destruction.

What Data do we collect?

We take care to collect only the absolutely necessary Data from you, which is appropriate and clear for the purpose for which it is intended. With the exception of any Data collected by Cookies (see more Cookies Policy), the Data is limited to what you fill in on forms found on our website www.brandsamsara.com. These may relate to:

How do we use your Data?

The processing of your Data is carried out either by the Company's staff, or through computer systems and electronic devices by the Company and, exceptionally, by third parties who carry out tasks necessary to achieve the purposes strictly related to the use of the website and the sale of products through the website (see below "Who are the recipients of your Data?").

More generally, your Data are processed in order to provide you with the following services:

- Product orders:

The Business processes your Data in order to fulfil its contractual relationship, to process the product order, to provide customer service, to comply with legal obligations, to oppose, raise or exercise legal claims.

- Create a User Account:

The Company processes your Data in order for you as a supplier to enjoy exhibition/display services and purchase on consignment of products via the internet, shipping of products.

- You will be able to send us a newsletter:

The Business provides you with the opportunity to choose, if you wish, to be informed at your e-mail address about promotional/advertising activities carried out by the Business (e.g. new products on the website, any offers, competitions, etc.).

- Contact:

The Merchant uses your Data to respond to the requests/queries you submit through the contact form or by email.

 

What do we process your data for?

We collect your Data for the purpose of providing products and/or services of the Company, through the website www.brandsamsara.com and in particular for:

managing the sale of our products and/or services, e.g. communicating and informing you about their availability and the progress of your order, the execution of your order, the shipment of the products, the management of debts to the Company, the making of returns, the evaluation of the products through the personal account, the receipt of your items, the Company's debts to you, and the return of the items to you.

 

- the promotion of the items we have on deposit,

- informing you about the development of the deposit by object,

- the report from the quality control, authenticity of the objects,

- the display of them,

- price changes (discounts),

- the sale of these and

- payment after the sale,

- returns and donations of the items,

- sending newsletters about our products and/or services,

- monitoring, improving and adapting your preferences and choices regarding our products and/or services.

- complying with the obligations imposed by the applicable legislation in force from time to time, e.g. tax legislation, e-commerce directive.

 

The processing of your Data is carried out in accordance with:

- the terms of our contractual relationship, i.e. the deposit of products,

- your consent, where required,

- our obligations arising from the law (e.g. tax legislation, e-commerce legislation, etc.),

- the legitimate interest of our Business.

Who are the recipients of your Data?

We do not transmit your Data to third parties. Exceptionally, access to your Data is granted to Processors who are located within the EU and process the Data on our behalf and in accordance with our instructions, in particular the courier companies we work with DHL EXPRESS to enable the dispatch/receipt of goods from/to you and providers of marketing services or software and communication tools that assist us in promoting the products on consignment and facilitating our communication with you.

The Merchant is not responsible for any disclosure of personal data of users to third parties, if this occurs through no fault of its own, in the context of transactions carried out through the Merchant.

How do we ensure that Processors respect your Personal Data?

The Processors we use agree and commit to:

- Maintain confidentiality,

- to maintain confidentiality, to respect confidentiality and not to send Data to third parties without the Company's permission,

- to take appropriate security measures,

- To comply with the legal framework for the protection of personal data and in particular Regulation 979/2016/EU (otherwise known as GDPR).

Do we send your Data outside the EU?

We do not send your Data outside the EU. Your Personal Data is stored and processed only within the EU. .

How long do we keep your Data and when do we delete it?

We keep your Data for as long as necessary in order to provide you with the products/services you request, unless an extension of this time is required due to legal claims or legal obligations of the Company.

The Merchant will keep the Client's Data for as long as a contractual relationship is maintained between them, both in paper and electronic form. If, for whatever reason, this is interrupted, the Merchant will keep it for as long as still required until the limitation period of any relevant claims has expired.

Your declaration of consent for sending a newsletter is kept for as long as you receive a newsletter from the Merchant and in any case no longer than six months after the discontinuation of the newsletter.

We delete the Data collected by Cookies in accordance with the Cookies Policy.

 

Is your Data safe?

 

We are committed to safeguarding your Personal Data. The processing of your Data in any way is only allowed to persons authorised by us, our employees and partners exclusively for the purposes mentioned above.

We have taken the necessary and appropriate organizational and technical measures to ensure the security and protection of your Data from any form of accidental or unlawful processing, both physically and logically secure.

These measures are reviewed and modified when necessary.

The Merchant is not liable for any disclosure of personal data of users to third parties, if this occurs through no fault of its own, in the context of transactions carried out through the Merchant.

 

What are your rights?

- Access to your personal data.

This means that you have the right to be informed by us how and what Data we process. You can ask to be informed about the purpose of the processing, the type of your Data we hold, who we give it to, how long we store it, whether automated decision making takes place.

- Correction of inaccurate Personal Data.

If you find that there is an error in your Data, you can correct it through your personal account (for suppliers) or submit a request to us to correct it (e.g. correcting your name or updating a change of address) (for buyers).

- Right of deletion.

You can ask us to delete your Data if it is no longer necessary for the processing purposes mentioned above.

- Right of portability of your Data.

You may ask us to receive in a readable form the Data you have provided or ask us to transfer it to another controller.

- Right to restrict processing.

You can ask us to restrict the processing of your Data for as long as your objections to the processing are pending.

- Right to withdraw/object to the processing of your Data.

You may object to the processing of your Data or withdraw your consent where it has been required and we will stop processing your Data if there are no other compelling and legitimate reasons that override your right or if it is no longer necessary for the processing purposes stated above.

When do we respond to your Requests?

We will respond to your Requests free of charge without delay, and in any event within (1) month of receiving your request. However, if your Request is complex or there are a large number of Requests, we will let you know within the month if we need to obtain an extension of another (2) two months within which we will respond to you.

If your requests are manifestly unfounded or excessive in particular because of their repetitive nature, the Merchant may impose a reasonable fee, taking into account the administrative costs of providing the information or performing the requested action, or refuse to follow up on the request by giving reasons in its reply to you.

Do we use automated decision-making/including profiling when processing your Data?

Our Company does not take decisions based on automated processing of your Data, except in the case of the use of cookies on our website, always after informing you and obtaining your consent to profiling, which, however, has no legal consequence and commitment for you.

What is the applicable law when we process your Data?

The applicable law is Greek law, as formulated in accordance with the General Data Protection Regulation 2016/679/EU, and in general the applicable national and European legislative and regulatory framework for the protection of personal data.

The competent courts for any disputes concerning the Data are the Courts of Athens.

Where can you appeal to check whether your rights have been respected?
